Foreword

I find that the end of the year always provides an opportunity
to reflect on the ups and downs of the last 12 months, and what
a year it's been! The introduction of changes to QOCS in April
and the sweeping changes to FRC in October have barely given
us time to pause for breath. But pause we did at the recent
PI Awards to celebrate our success in being awarded Insurance
Provider of the Year against a field of very strong competitors.
Our last edition of EvaluATE for 2023 looks back at the changes
that have influenced the last 12 months and looks at what is to
come and how we can adapt to meet the challenges ahead of us.
As an insurer, I think it is still too soon for us to have seen any impact
from the changes to QOCS, and we have yet to hear of any material
change in behaviour by defendants. That said, much of the market
has been more focused on how to address the introduction of
an Intermediate Track and the consequences such a change brings.
This is particularly so in an environment where further change is
inevitable as Government seeks to address some significant gaps and
where economic challenges are forcing law firms to fundamentally
look at how they operate their businesses.
Mediations, resolution meetings and stock-takes all have their place
in helping to reduce the pressure on claimants and will in many
instances bring cases to a timelier conclusion than might otherwise
be achieved, given the current delays in our court system.
